Unbox Galaxies (pty) ltd. (UNBOX) TERMS OF USE

Unbox Galaxies Proprietary Limited is the proud creator and owner of Eden Aurora, a social web3 platform that provides access to various content, such as digital media, art, software, text, design, and functionality. These Terms of Use (referred to as “Terms”) govern your use of Unbox Galaxies, including your access to the site, interaction with the platform, and utilization of the services provided by Unbox Galaxies Proprietary Limited, its subsidiaries, and affiliates (collectively referred to as “Unbox”, “us”, “our”, or “we”). As a user (“you” or “your”), please carefully review these terms before engaging with the site.

By accessing or using the site, whether as a site visitor or registered user, you acknowledge and agree to abide by these terms. We reserve the right, at our sole discretion and at any time, to modify these terms. Any changes we make will take effect immediately upon notice, which may be given in any form, including, but not limited to, posting on the site or via email. Your use of the site after such notice will constitute your acceptance of the changes. We advise you to review the terms regularly to stay familiar with the latest version. To use the site, you must be at least 18 years old. By accessing or using the site, you warrant and represent that you have the legal capacity to enter into a binding agreement with Unbox. If you do not agree to these terms, please refrain from using the site.

OWNERSHIP AND LICENSING OF UNBOX CONTENT

All intellectual property rights of Unbox’s site belong to Unbox or our licensor, and any unauthorized use of the materials on the site is strictly prohibited and may violate copyright, trademark, patent, and other laws. By using the site, you acknowledge and agree that you do not acquire any ownership rights to Unbox’s intellectual property.

However, except as stated otherwise in these terms, Unbox does not claim ownership over your intellectual property.

Unbox grants you a restricted, non-transferable, and non-exclusive license to use the site. You may not reproduce, distribute, adapt, modify, translate, create derivative works from, publish, or use any part of the site for any purpose without our express prior written consent, except as required to exercise the license grant mentioned above.

By using the services, you grant Unbox a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable right, and license to use, reproduce, publicly display, distribute, and adapt your assets. This right is granted for the purposes of providing and promoting the service and your assets. You also give Unbox the right to use your name and trademarks (if any) in connection with our use of your assets.

If you engage in any financial transactions by purchasing and/or selling assets on the marketplace, those transactions will be conducted solely through the OpenSea Marketplace, using Ethereum-compatible wallets and browsers. Unbox has no ability to reverse any transactions, and therefore will not be liable for any claims or damages arising from any transactions you engage in on the marketplace.

Each sale made in the marketplace is subject to a fee payable by the buyer to Unbox, which is automatically applied as part of the sales transaction.

Unbox will not be responsible for the payment of any sales, use, value-added, or other taxes, duties, and assessments (except for income tax) imposed by any governmental authority as a result of your ownership, transfer, or creation of assets on the site.

PURCHASING VIRTUAL DEEDS IN Eden Aurora

You have the option to buy virtual deeds within Eden Aurora, but you must adhere to these terms, and you cannot link to or contain any illegal content. We hold the right to moderate and/or delete any metadata that violates these terms.

RISKS

By using our services, you agree that any purchase or sale of assets made by you will be entirely at your own risk. We explicitly deny and disclaim any liability towards you and reject any obligation to indemnify or hold you harmless for any losses incurred during transactions. By using our service, you acknowledge that it is non-custodial and that we do not, at any time, hold custody of the assets belonging to our users. We do not store, send, or receive assets as they exist on the blockchain. As a result, due to the decentralized nature of the services provided, it is solely your responsibility to protect your wallets and assets from any and all potential risks.

You assure that you understand that cryptocurrencies and any related activities are inherently high-risk and highly speculative, and any losses related to such activities are at your own risk. The contents of the site are for informational purposes only. It is crucial that you conduct your research and analysis independently, verify any information you find on the site, consider your personal circumstances and objectives, and seek independent financial advice from appropriate professionals before making any investment decisions or taking any other actions.

You warrant that you will ensure, to the best of your knowledge and belief, and after due diligence, that no money laundering or other unlawful act is committed concerning the use of the site, and that no proceeds of any money-laundering activities are used in connection with the site.

You accept responsibility for any risks associated with purchasing user-generated content, including the risk of buying counterfeit assets and assets that may become untransferable.

Unbox provides the service “as is” and “as available” and makes no express or implied warranties of any kind regarding the operation of the service. Your use of the service is solely at your own risk. To the fullest extent permissible by law, Unbox disclaims all warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

We do not guarantee continuous, uninterrupted, or secure access to the site or that the information provided on the site will be accurate, reliable, complete, or current, and free from errors, defects, viruses, or other harmful elements.

Unbox will not be liable for any loss of profits or any indirect, incidental, punitive, special, or consequential damages arising from or in connection with these terms to the fullest extent permissible by law.

You agree to indemnify and hold Unbox, its directors, and employees harmless from any claims, losses, or damages resulting from any breach of representation or warranty, the exhibition or exploitation of your assets, or any negligence or default by you, your employees, authorized agents, or independent contractors.

If you become aware of any legal claim or action related to these terms or your assets, you agree to notify Unbox promptly in writing. The warranties, representations, and indemnifications contained in these terms shall survive any termination or expiration of these terms or your relationship with Unbox.

We reserve the right to modify or discontinue any part of the service at any time and without notice. Unbox may refuse access to the service, terminate your rights to use the service, or prohibit you from creating or uploading assets at any time and at our sole discretion. However, you will remain the owner of your assets as outlined in these terms.

OTHER WEBSITES AND SERVICES

The service may contain links or features that allow you to access third-party websites that are not owned or controlled by Unbox. These third-party websites are subject to their own terms of use and Unbox has no control over their content. Unbox is not responsible for any disputes that may arise between you and third parties regarding third-party websites or their offerings.

GOVERNING LAW

The rights and obligations of both parties and the interpretation of these terms will be governed by the laws of the republic of South Africa without regard to its principles of conflict of laws.
